I thought false advertising was against the law?

Atkins is now a brand name and the company that owns the name approves
the usage of the name.

Dr. Aktins is dead. The Atkins company is alive and well. No need
to communicate with the dead.

False advertising for dietary supplements is not against the law. They don't
have to be safe or effective. That's why you see so many penis enlargement
ads and fake diet pills.

When Atkins died, his beneficiaries initiated some aggressive marketing.
Places like Subway have to be legally licensed to use the Atkins logo and
"stamp of approval". Otherwise, they would, indeed, be making claims
illegally.
Most other claims are more generic in nature (eg "low carb friendly", etc.).
These are the claims that one needs to be careful with.
